As I’ve mentioned previously, to defend the Photo ID Law against the constitutional challenge in the Applewhite case, the Commonwealth will need to show that there are no less restrictive means of accomplishing its stated goal of preventing voting fraud. In their Petition, petitioners noted that the voter ID laws in Florida and Arizona are less restrictive than the Pennsylvania law because those laws permit voters who do not have an ID to vote after filling out an affidavit confirming their eligibility.
Petitioners now can add New Hampshire to the list. According to this news report, New Hampshire just passed a voter ID law that permits voters who do not have ID to vote by filling out an affidavit at the polls.
